Are there Cultural differences in Chinese and American Negotiations - Essay Example These cultural differences make negotiations between nations extremely complex. Negotiations between two nations with different cultural views need a specific agreement which suits both parties. For instance, negotiations between America and Chinese may prove to be difficult since the two countries have completely different cultural views. These cultural differences include the take on freedom of expression, collectivism and individualism, social structure, moral and values and business relations. Since the two nations are among the trade super powers in the world, they must find a way to carry out these negotiations. This paper will highlight the cultural differences between the two nations and ways in which they incorporate their differences to carry out successful negotiations. The paper will also give a clear perspective on whether the negotiations are made out of will or out of circumstances. In an attempt to get a clear perspective of the entire theme, the following questions w ill be highlighted; how can Chinese corporate people respond or behave in a different way from American corporate people in international trade negotiations? Are the experiences and outcomes of tension in negotiations similar for Chinese and American business personalities? Do Chinese and American representatives feel diverse levels of anxiety in international business discussions? Do Chinese and American representatives respond to anxiety differently? Firstly, the American negotiating culture is guided by the lawyers. Americans believe negotiation to be an activity in international relations while Asians believe it to be a provision of the paternalistic company heads to create lasting relations. All American negotiators are bound with contracts or legal solutions, whereas customary Asian negotiators believe that relationships are the solution to a business and that contract are just written records of accord between people. Americans put these papers into perspective more than find ing lasting relationships with individuals. With this difference the two nations may find it difficult to be bound by a legal document (Pervez, 2003).The Chinese also believe and want a relationship without the consent of legal documents while America on the other hand, insists on the legal approach of negotiations. The American negotiation culture is the only culture that believes that liability can be allocated in advance through a written agreement. This is one of the numerous features of international negotiation that has grown to be normal, but it still hits traditional Asian negotiators as foolish- that Americans believe contracts binding even as the sales environment changes. Generally, Asian negotiators and Chinese to be specific believe that as the external position change, so must a corporate relationship. Scores of Chinese partners have been puzzled and disappointed when their American counterparts begin waving a piece of paper in their face instead of taking action fairl y and wisely to new market realism. Ancient Egyptian and Mesopotamian Civilization Essay Many ancient civilizations developed as a result of the Neolithic Revolution, or the turning point in which the utilization of systematic agriculture created societies. Two civilizations, Ancient Egypt and Mesopotamia, both transformed into civilizations by changing from nomadic hunter-gatherers to agriculture and trade civilizations. Both civilizations were created as a result of the same revolution, but they still differ in numerous ways. Egypt and Mesopotamia had similarities and differences in religion, social and political structure, and geography. These variations shaped the two civilizations into completely contrasting societies. The religion of Egypt greatly differs from that of Mesopotamia, yet it is also similar. First of all, the ancient Egyptians believed in an afterlife and resurrection for all people, whereas the Mesopotamians believed in only a world of darkness after death. Both Mesopotamia and Egypt were polytheistic civilizations, meaning that they both believed in multiple gods or deities. Ancient Mesopotamian religion is associated with biblical mythology. Egypt and Mesopotamia had drawings and artwork to represent and worship their gods. They each believed in prayer as a form of interaction with their gods. Since Egyptians did believe in an afterlife, they performed a process known as mummification to preserve the bodies of the people who passed. The priests would remove organs, preserve the body, and bury them in tombs along with the items one would need in the afterlife. Not all Egyptians were mummified. Only the wealthy or important people were mummified in hopes that they had the afterlife they deserved. The religions of these civilizations developed differently. Social and political structure of a civilization can vary depending on religion, economy, and the technology available to the people. Egyptian social structure resembles Mesopotamian social and political structure because they are both able to be thought of as a pyramid; the least important, poorer subjects are at the base of the pyramid, the commoners and average people are in the middle, and the kings, priests, or pharaoh belong at the top, except there was no middle class for Egypt. There was a Pharaoh and its subjects. Egyptians had pharaohs, while Mesopotamia had Kings and priests. Egypt had priests, but they were not higher than the pharaoh. Priests were able to speak to the gods, teach, and go through with the process of mummification. Pharaohs were said to be very god-like and after their death, become a god. In Mesopotamia, the priests were the highest in means of communication with the gods. Kings were trusted to protect and better the kingdom or empire. Mesopotamia would raid hill peoples for potential slaves and Egypt would keep prisoners of war as slaves. Slaves did not have rights, but in Mesopotamia they were still treated as a whole being, like the commoners and were the lowest possible class of the two civilizations. The Egyptians had a centralized government with a Pharaoh as the ruler, and its subjects serving them. The Pharaohs has one main servant that is in power to make small decisions in the case of the Pharaohs request. They are called vizers and somewhat resemble having the privileges that a prime minister would. In Mesopotamia, they have a king and either a city-state government or an aristocracy, meaning the wealthy individuals and families are more powerful that the commoners. Peasants are able to own land in Mesopotamia, but they must provide a portion of their harvest of wheat or barley to pay a tax for their land. Egypt and Mesopotamia had similar form of empowerment, and their governments were also somewhat similar. The geography of Egypt and the geography of Mesopotamia directly affects the development of the two civilizations. Egypt is located in northern Africa and one river, the Nile, runs through it. The Nile river was a geographically asset to the Egyptians, with fertile silt and soil lining its banks. They called this black land, which they used for farming. The Nile occasionally flooded, but it was predictable and the Egyptians learned to control the flooding to use it to their advantage. They created irrigation systems that utilized the floods. Egypts early civilizations did not expand very far from the Nile river because of what they called red soil. Red soil is the barren desert, which provided a natural blockade from other invasive armies. The desert did not have arable land and was of no real use to the Egyptians. They were relatively isolated due to the surrounding desert, but the desert did provide glass and precious metals for trade. Mesopotamia was amongst two rivers, the Euphrates and the Tigris. Mesopotamia has a Greek making of between the rivers. The rivers were unpredictable when it came to flooding and were thought of as signs from god. When the Mesopotamians experienced a flood, they believed it was due to upsetting the gods. The rivers run through present-day Iraq and the Euphrates runs through a portion of Syria. The southern region of Mesopotamia was marshy wetland due to the flooding of the rivers, and the northern region of Mesopotamia was hills and plains. Contact and communications without outside civilizations near Mesopotamia as important to them. The resources and geographic location of these areas allowed for their development and growth into civilizations. Mesopotamia and Egypt are civilizations that grew on completely different continents under diverse conditions. The Neolithic Revolution allowed for the change in lifestyles of Egypt and Mesopotamia. These conditions affected their beliefs and growth. The two are similar and different in their ideas and religion, structure, and geographic location.

Medieval Siege Weapons This is a brief paragraph or two on each of the major siege weapons. For the not just the besiegers but also the defenders. Please note most of these weapons were not used alone and often had many different versions of the same weapon. KNIGHT At age seven a son of a noble family was sent to a nobleman or lord, often who was a relative. Here he was a page and taught how to ride a horse, and his manners. At the age of fourteen he was apprenticed to a knight. As the squire to the knight he would take care of his horse, help him put the knights armor on and keep it clean. In turn he was taught how to use a bow, carve meat, and other knightly skills. The squire would have to go into battle with the knight to help him when he was wounded or unhorsed. If the squire was successful he would be knighted at the age of 21. When there wasn't a war going on knight would have to practice, practice, and practice some more. They would wrestle, fight with blunt swords, do acrobatics, and also do sports like javelin and putting which is throwing a heavy stone as far as you can. Experienced knights would participate in tournaments held by the king. The winner would usually just get bragging rights and sometimes a sum of money. The most common event was jousting. Jousting is a sport where to fully armored knights ride at each other on horses while aiming a long wooden lance at the each other. With speeds reaching 60 miles per hour sometimes there could be fatal accidents. If the person was knocked off the other was victorious. CATAPULTS The catapult, was invented by the Romans, and plays a large role in the siege of any castle. Besiegers could fire 100-200 pound stones up to 1,000 feet. The catapult was used to destroy buildings and walls inside and outside of the castle walls, it could also destroy an enemies moral by throwing severed heads of comrades, they could spread disease by throwing shit and dead animals in, and they could destroy wooden building by throwing bundles of fire in. Earlier models just used a large weight on one end of a pivoting arm. The arm was pulled back the missile was placed and then let go.

Alayna Grant Dr. Bellah English 1301-015 February 15, 2013 Strange Place On July 11th it will be twelve years since I discovered the magical world of yuccas and mesquite trees. I remember the day like it was yesterday. I remember driving all the way down the road that seemed like miles and miles of nothing but wilderness. We seemed to have driven for forever. There were no houses or mobile homes or much of anything. Then we came to a dirt road, and I said â€Å"Daddy I hope we are not going to drive into there. † There looked like an unmarked, mysterious place.It was a new unfamiliar place that I would be the first to discover. As soon as we got out of the truck I started asking questions. â€Å"Daddy is there dinosaurs here? † Then he explained that I would have to go check for myself, so I made that my personal mission. We came back a few days later because he was going to set up the layout of the house, and all that good stuff was going to be put together. I came pre pared this time; I had my binoculars, my toy gun, and my camera. I had my pink binoculars so I could see trouble that I might get into far away.I had my gun in case there was a dinosaur. Finally I had my camera so I could prove to my dad that there were dinosaurs. â€Å"Well here I go. † I said to myself. I start walking and before I know it I’m in this mysterious place. I am seeing things I never saw before. All these trees around me look evil; they have very long, sharp, pointy thorns on them. There were these weird plant look-alike things that I accidently stepped on that poked me and made blood droplets on my leg. There was this mean looking frog that had horns. And before you knew it I had gotten in too deep and was lost.All I could see that was familiar was the baby blue sky and the bright golden sun. So I kept going hoping I would find maybe a sign or a trail. I held my gun close to me just in case I found a dinosaur. Then out of nowhere hops a little grey bunny , he stops to look at me for a second then starts to hop off. I thought to myself â€Å"Maybe if I follow him I can get back to my daddy. † So that’s what I did until he was out of sight. I grabbed my binoculars to try to find him, but he was long gone. He hopped way too fast and I could not hop over the weird looking plants fast enough.So there I was again stuck alone and there were still no signs of any dinosaurs yet. â€Å"Maybe there are not any dinosaurs out here in this place. † I thought to myself, but I’ll keep looking. Gazing through my binoculars I came across something black, something that looked like I had seen before. I start walking faster and faster towards it. And before too long I was back at my dad’s black truck. â€Å"Whoa I thought I was going to be lost forever out here. † I said to my dad. He asked me â€Å"Did you find any dinosaurs’ baby? † And with a sad sounding voice I said â€Å"No but if we build a house out here I can look forever! †

This card is an advertisement card used for readers to request product or service information, and potentially could be generating fewer leads than in the past (Cooper & Schindler, 2014). The research division of Penton Media conducted a meticulous research with many diverse readers through various diverse forms of communication. Penton Media is now faced with the challenge on determining if this reader service card will sustain ad be beneficial in the future. The survey is not clear and is perplexing. Questions should be directive and closed ended. In this survey the questions asked are not directive questions, but moderately open ended questions that would discourage a user from completing the survey. When the questions are not specific it would give feedback that is not what key decision makers are seeking. The wording of the questions is equally adequate for the responses needed; but, they could be more designed to yield desired results. This method could motivates users to not only complete the survey, but also provide honest and reliable feedback. There is not enough purpose or direction present to encourage the participant to give revealing answers (Cooper & Schindler, 2014). Having a more direct, concise, and structured questionnaire would not only get the feedback that is warranted, increase participation, but more time could be used to reevaluate the response that are received. This survey was not designed properly to accomplish the specified objectives. Coding involves assigning numbers or other symbols to the questionnaire for the purpose of grouping the data (Cooper & Schindler, 2014). For each question the researcher must assign numbers to each response available in order to code the data correctly. A code sheet will allow an SPSS system to quickly find the frequency, percent, valid percent, and cumulative percent of each response. The detail of the code sheet will produce detailed SPSS results which will allow the researcher to clearly interpret the data.

Prehistoric Life During the Cenozoic Era Facts About the Cenozoic Era The Cenozoic Era is easy to define: its the stretch of geologic time that kicked off with the Cretaceous/Tertiary Extinction that destroyed the dinosaurs 65 million years ago, and continues down to the present day. Informally, the Cenozoic Era is often referred to as the age of mammals, since it was only after the dinosaurs went extinct that mammals had the chance to radiate into various open ecological niches and dominate terrestrial life on the planet. This characterization is somewhat unfair, however, since (non-dinosaur) reptiles, birds, fish, and even invertebrates also thrived during the Cenozoic! Somewhat confusingly, the Cenozoic Era is divided into various periods and epochs, and scientists dont always use the same terminology when describing their research and discoveries. (This situation stands in stark contrast to the preceding Mesozoic Era, which is more-or-less neatly divided into the Triassic, Jurassic and Cretaceous periods.) Heres an overview of the subdivisions of the Cenozoic Era; just click on the appropriate links to see more in-depth articles about the geography, climate and prehistoric life of that period or epoch. The Periods and Epochs of the Cenozoic Era The Paleogene period (65-23 million years ago) was the age when the mammals began their rise to dominance. The Paleogene comprises three separate epochs: * The Paleocene epoch (65-56 million years ago) was fairly quiet in evolutionary terms. This is when the tiny mammals that survived the K/T Extinction first tasted their newfound freedom and began to tentatively explore new ecological niches; there were also plenty of plus-sized snakes, crocodiles and turtles. * The Eocene epoch (56-34 million years ago) was the longest epoch of the Cenozoic Era. The Eocene witnessed a vast profusion of mammalian forms; this was when the first even- and odd-toed ungulates appeared on the planet, as well as the first recognizable primates. * The Oligocene epoch (34-23 million years ago) is notable for its change in climate from the preceding Eocene, which opened up even more ecological niches for mammals. This was the epoch when certain mammals (and even some birds) began to evolve to respectable sizes. The Neogene period (23-2.6 million years ago) witnessed the continuing evolution of mammals and other forms of life, many of them to enormous sizes. The Neogene comprises two epochs: * The Miocene epoch (23-5 million years ago) takes up the lions share of the Neogene. Most of the mammals, birds and other animals that lived during this time would have been vaguely recognizable to human eyes, though often considerably bigger or stranger. * The Pliocene epoch (5-2.6 million years ago), often confused with the ensuing Pleistocene, was the time when many mammals migrated (often via land bridges) into the territories that they continue to inhabit during the present day. Horses, primates, elephants, and other animal types continued to make evolutionary progress. The Quaternary period (2.6 million years ago to the present) is, so far, the shortest of all the earths geologic periods. The Quaternary comprises two even shorter epochs: * The Pleistocene epoch (2.6 million-12,000 years ago) is famous for its large megafauna mammals, such as the Woolly Mammoth and the Saber-Toothed Tiger, that died off at the end of the last Ice Age (thanks partly to climate change and predation by the earliest humans). * The Holocene epoch (10,000 years ago-present) comprises pretty much all of modern human history. Unfortunately, this is also the epoch when many mammals, and other forms of life, have gone extinct due to the ecological changes wrought by human civilization.

With the new found image of the nation and world as a whole, the reforms advanced the position of the previously ignored people of the nation, as did its reincarnation and rebirth apparent in the New Deal. Although the first signs of this pristine Progressive movement shone since the mid-1800s, no one had cleared the way for its momentous effect upon the nation in the same degree as Theodore Roosevelt. Although at times hot-tempered and brash, his charismatic attitude pushed forward many of the original progressive legislations. For example, his Sherman Anti-Trust Act proposed the life of a trust should be based on its history and actions, since he believed good trusts existed along with bad ones. Next, the Elkins Act proposed railroads and shippers to offer rebates illegal. They also had to have fixed rates, and couldnt change without notice. Also, the Hepburn Act gave ICC the power to set maximum railroad rates. Next, of course because of the impetus for reform provided by the many socialist writers, such as Upton Sinclair, was the landmark Pure Food and Drug Act and the Meat Inspection Act, protecting the health and safety of consumable products and establishing the Food and Drug Administration. He also wished to preserve the untainted countryside, and established the National Forest Service and also strengthened the Forest Bureau. He also passed the Newlands Act which helped to create subsidies for irrigation in 16 western states. Every year in United States there are approximately 750000 cases of stroke and half of them are first stroke events that leave around 300 000 people with some form of disabi lity or impermanent (Raphael et al 2006). These large incidences of stroke cause heavy burden on the society but also on the individual lives of the patients, on their physical, emotional and social wellbeing and the wellbeing of their families. This is because more than 50 percents of these patients will be unable to take care of themselves and will need some form of support from a second person in order to be able to satisfy even the basic needs (Rothwell et al 2004). Of Mice and Men Essay John Steinbeck, the American author of this emotional novel, was bought up in Salinas. His family owned a lot of land, therefore meaning he was quite rich. He went to university to study writing and left without a degree as he dropped out half way through the course. However he took up work as a labourer and a journalist. I noticed how Steinbecks background really inspired him to write a book like Of Mice and Men. It shows how he wants to let out all his emotions as a child into this book. He, George and Lennie have a lot in common. The American Dream is belief in the freedom that allows all citizens and residents of the United States to achieve their goals in life through hard work. Everyone has a dream that they want to achieve somewhere in their lifetime. There are two different types of The American Dream. The first is the entitlement of land- freedom, just like George and Lennies dream. The other is luck, fame and money just like Curleys wifes dream in the book. In 1929 the Wall Street Crash was introduced which led to on going recession. This also led to failed businesses, harsh poverty and long term unemployment. At this point men couldnt afford to have families so therefore men travelled alone just like George and Lennie. There was no heath care so the only hope left was dreams. The book is called Of Mice and Men but is that what it has always been called? The actual title was Something that happened. This suggests something that you as the reader were not involved in. Steinbeck also wrote this book as a detached narrator, so he as well was not involved in the action. He began writing it in early 1936 and it was published in 1937. The book was immediately successful. Even now this book shows so much meaning of how The American Dream was so important to the people in the 1930s. This was because dreams were the only thing American people had to depend on. Dreams can take you away from the real world. A dream can sometimes make a person be very selfish. Sometimes you need to come away from your dream and think about others. Throughout the first chapter of Of Mice and Men is just setting the scene. The first time we saw George and Lennie was in an open pool. They soon find a bunk house with lots of other men to share with. The ranch where both men worked was in Salinas, where Steinbeck himself was brought up. Steinbeck was showing that the settings were slowly closing in so you feel more isolated. Steinbeck produces two very different characters which are most like him. That is the reason why both characters have such a major roll to play. George and Lennie have the most unique bond throughout Of Mice and Men. Both have gone though very hard times with Lennie being retarded and George having to keep a constant eye on him and not being able to pursue his dream alone. We start to get an image that Lennie has a disability in the early stages of the book, just the way he behaves. Lennie dipped his whole head under, hat and all. Look George. Look what I done. This shows us that Lennie has a child-like mind and wants to impress and please George. It is very enigmatic that two men are travelling together, alone. However this was very typical to do this at the time because of societys pressure. What is very astonishing about Lennie and George is that they are both very different from each other. Lennie is a big man who has a disability because he got hit by a horse when he was younger. George is a complete contrast to Lennie as he is a small man always aware of what is going on around him and conscious of what is happening. George and Lennie both have a dream but are not necessarily the same. Steinbeck represents this by describing in such detail what they want together. We could live offa the fatta the lan. The irony is about the countryside they are in, it is rich. They are living of the bounty of nature. Money and family are not mentioned in the dream. It provides them with everything they need. We could have a few pigs. When the fruit come in we could can it. Every Sunday wed kill a chicken or a rabbit. Steinbeck uses we a lot in the dream. It shows that the dreamed is shared between Lennie and George. The repetition emphasises this. Steinbeck creates the dream mainly by using dialogue. By having George and Lennie discuss their dream together allows the reader to have a sense that they have been planning this dream together and not alone. George and Lennies interpretation of the dream is slightly different. Lennie wants to tend the rabbits as he likes feeling soft things. George also has a dream of his own. He could get a job, eat at any place he likes, stay in a hotel, and get a gallon of whisky. However Lennie is stopping him from doing all of this. George needs Lennie and Lennie needs George. All George wants is love and affection and he knows he cant get that, because after everything that has gone on, it is hard. George is still with Lennie because Lennie himself is a big man so he can protect George from other people. Lennie is stopping George from achieving many dreams, but the reason why George is still with him is because Lennie is the only person George has got. George has no family nor does he have friends. He only has Lennie. George has a short temper and lashes out at Lennie very often verbally. Lennie is a fragile man who doesnt like seeing his comrade like this. You can tell that they both care about each other an awful lot. Another way that Steinbeck represents the American Dream is how Candy lost his companion. Candy had a lot of dreams when his dog was alive. This is because the dog had been through everything with him, but now that he and his dog was getting old there was only one thing left for Carlson to do. A shot sounded. Candys dream had just been killed. The second that bullet hit that dog, Candys dreams were shattered. His dog was a part of Candys dreams A dream could be in the in the past or the future. In Candys case it was all in the past. His dog had been through everything with him. This is a similarity between George and Lennie who have also been through everything with each other. Candy knows that nobody could ever replace his dog. Slim offers him any of the pups but Candy just remained silent. Candy feels that he cant achieve anything without his dog anymore. That is why he he lays in his bed silent for a long time. He treats the dog like a human, as part of his family, someone really close. That is what makes Candy be so silent for a long period of time. As Candy lays there silent on his bed he overhears George and Lennie talking about their dream. Again Steinbeck reveals the dream by dialogue. They talk about how one day they are going to get out of the ranch and live offa the fatta the lan. As Candy listens to their dream in such detail he asks if he can be a part of it. An old dream has ended but a new one is just beginning. Dreams are pacific to an individual however sometimes a dream could be a part of a team. This is exactly what Candy wants to do with George and Lennie. He wants to share their dream and be a part of it. After all shared dreams are much stronger than individual ones. Steinbeck now introduces and individual character that defines him from the rest of the ranchers. Crooks is the only black man on the ranch therefore he is excluded from society. He is separated by being pushed into a disassociated room. He is not allowed to socialise with the other ranchers because of his race. In the 1930s Americans were against anyone who were coloured. These people would not get treated fairly and would usually get beaten up just for the colour of their skin. Crooks father did not want him socialising with white people because he knew that they will abuse him. The American Dream is about equality of all men. This is where Crooks rights come in. The irony here is that segregation leads to a better life. A very unusual thing about Crooks is that he is the only one who can read; hence conveying that he is very well educated. We know that Crooks has already had his dream just by the way in which he speaks to Lennie. Crooks and Lennie both have a disability. Although he feels appreciated that Lennie is around him, Crooks speaks in a very negative manner about Lennies dream. An never a God damn one of em ever gets it. Crooks is contradicting to Lennie that dreams can never be achieved. However if you dont try to achieve your dream, it will never come true. Crooks suddenly changes his mind about the dream and hesitates as he asks Lennie if he could be a part of the dream too. Crooks dream is about having those long dark nights alone change by having people talk to him and communicate with him. His dream is all about regaining sense of belonging with others. Crooks heart wants the dream but his mind is not allowing him achieve it because his background has knocked his courage. We know from the American Dream, his experiences in the past have made him so brittle and angry. However Crooks can be very venerable to people that are more powerful than him, such as Curleys wife. Steinbeck introduces another unique character into Of Mice and Men. Curleys wife is the only girl on the ranch therefore she is also excluded from society. Even though she is more powerful than Crooks, she is not all that different from him. Both are very lonely and want someone to talk to. Both are at a disadvantage, Crooks with his race and Curleys wife with her gender. Curleys wife does not know what to do in life. We know her dream was to be an actress, but was crushed by her very own mother. Now her dream is to be more grown up. She dresses like an adult with make-up, her hair done up and a stylish dress. However she is still described by Steinbeck as a girl. A girl was standing there. She wants to be respected from the men all around her. Being the only woman in the ranch can be intimidating. In the 1930s woman were less valued than men. They had fewer rights. The reason why she married Curley is to get some attention and be more respected because he was the ranchers son. Curleys wife is a mercenary; she married him for his money and as a rebound for her loss as an actress. Curley is very much respected by all the men so Curleys wife married him so all the men could look up to her just as they do to Curley. Curleys wife unexpectedly lets her true feelings out to Lennie. I dont like Curley. He aint a nice fella. This shows that she is using him but at the same time Curley is using his wife. However Curleys wife moved to the countryside to get a better life but after two weeks she found out that she had made a mistake. She already hasnt got a good reputation. All the men think she is a bit of a tart. Two weeks married, and got the eye. This shows that she hasnt been married to Curley for a short period of time and yet she is being judged already just the by the way she looks and dresses. Curley says he keepin that hand soft for his wife. We instantly know that Curley himself is an abuser. We know this because his dream was to become a boxer. Having not achieved this dream he converts it into abusing women. Curleys wife is a lot more than what she looks. There is always a person inside who has a dream. The death of Curleys wife is very significant of Steinbecks treatment of the theme of the American Dream. We know this because Lennie was the one who shook her, shook her so much that he broke her neck, and killed her. Lennies character is very timid, so expectedly her runs away, trying to hide from society. We as the reader know Lennies dreams are going to come to an end, but we dont know how. That is how Steinbeck creates the atmosphere which makes the reader what to carry on. Lennie was the one who killed Curleys wifes dreams, so now Curley is going to kill his. When Lennie dies, the whole dream dies. We know that both Lennie and George do not have a family. They have each other instead. They care about one another which makes them so unique. I want you to stay with me here. This shows that even know Lennie thinks George is going to give him hell, he isnt. He cares about Lennie and he knows that if he doesnt kill Lennie himself now that the other ranch men will kill him, brutally. George slowly but in a clever way kills Lennie. He has made the choice of how Lennie is going to die. This is a complete contrast of how Candys dog died. George keeps the American Dream alive so it is the last thing that Lennie remembers. Steinbeck describes the dream in such detail so we can actually picture it ourselves. Lennie remembers that one day they could live offa the fatta the lan. Lennie has no idea of what George is building up to do. However we as readers know what is going to happen. Steinbeck builds up suspense of how George gradually kills Lennie. George describes how they are going to live with pigs and chickens. This is typical of the American Dream, a chance to get rich and have land. However that dream was collapsing all around them as they live in a poor barn house where all the men share the same room. Lennie is very reluctant about why George has forgiven him. Lennie says that he might as well just go away to show that after George said if I was alone I could live so easy. Lennie thinks by doing this it would make George happy. We know that if George kills Lennie, he could no longer for fill his dreams without his companion. Gradually Lennie gets very excited about their dream. Lets get that place now. That is when George pulls the trigger and lets Lennie go, for good. George made this choice of killing his best friend. Of what looks horrific, he is actually doing Lennie a massive favour. He was going to be killed anyway so why not do it with a blissful memory rather than a bloody one.

The Scope And Limitation Of The Study An Example The current traditional help desk mechanisms used in UUM-CAS postgraduate help desk department at UUM are no longer enough to support the increase of the interactions between the users and the technical support employees because There is no standard and organized process for handling the users requests. This paper proposes a technical support system that can help students, staff and even lecturers at UUM Postgraduate CAS department to freely interact with the customer service employees by sending their requests and inquiries through a web-based help desk system. In the other side, this proposed system will also increase the productivity of the employees of the customer service department since each specific ticket or problem will received by a specific group of the technical support employees. In order to achieve that , we are going to use a problem tracking technique . This technique will enable the users (students, staff or lecturer) to send their inquiries to the proper person in the customer service department. Also this technique will aim to track the problem or ticket of the users until it gets their direction to the proper person of the customer service employees who will try to solve it within a convenient time. CHAPTER 1 INTRODUCTION 1.0 Background Nowadays, a technical support service plays a main role in a Universitys ability to assist their students , staff and lecturers who really need some information and technical support guides. In the meanwhile , Educational institutions face the challenge of providing technical support to faculty, staff, and students for answering their questions and responding to their inquiries and problems with a suitable solutions and within a convenient time. (Cruess, 2002 and Niedzwiecki Peterson, 2002). Moreover, The main goal of customer service is to provide better overall service to the customer when they contact the customer service employees, either through email, or a phone call. We want to make sure that everyone is satisfied with the first answer they receive with a correct solution in a timely manner. We want to be proactive and resolve as many issues as we can before the customer even notices that something may have gone wrong. The customer should notice an improvement in the turnarou nd time when a help request is submitted, as well as a reduction in the number of times they have to ask for help until he/she gets the solution. (Schauer Thompson, 2004). This proposed study will make an enhancement in the current technical support mechanism used by the UUM Postgraduate technical support department. It will be conducted based on Problem Tracking Technique which help to ensure consistent and quality support, track the information and problems that come into the Help Desk and assign or forward the problems to the appropriate workgroup and follow-up to make sure the problems were corrected. Problem statement Previously, by using the traditional help desk tools, the web interface was just a simple interface with an engine for generating an e-mail to our support staff. When an e-mail is sent to the [emailprotected] for example, different staff will receive it. This sometimes resulted in duplication of work since multiple people could work on the same ticket or email, or no one would handle it since some groups would assume other groups or individuals would be handling a certain email. There was no standard and organized process for handling the users requests. Sometimes no one responded right away and other times multiple people did, showing that we were not very coordinated. The same thing happens when using a traditional phone call as a tool of communicating with the customer service (Schauer Thompson, 2004). Also Recently, there have been increasing number of interactions between users and customer service employees online. Therefore employees must take great deal of time to process in quiries from customers through the Internet (Iwai, Iida, Akiyoshi Komoda, 2010). In this research we are going to concentrate on the UUM Postgraduate CAS department to be as a domain of our study. In the meanwhile, students, staff and lecturers at UUM Postgraduate CAS department have always been able to submit problem reports via e-mail, or by phone. That is still true, but the question is : How effective is the use of these tools? In fact , The current campus help desk has become the hub of support with the many spokes of user services centered on it (Cruess, 2002). Students, staff and lectures do not have to be waited and passed on from one technical support employee to another until they get the answer of their problem or inquiry. In addition, once the student sends his/her problem to the help desk department by email , it will take long time until it gets solved. Because the ticket will not send immediately to the proper person that he/she is aware of the problem that has already been sent .In this case, the number of times that they have to ask for help will increase . As a consequence, and based on the points that we mentioned previously, we proposed a web-based help desk system that can be used as a bridge between the users (students, staff, lecturer) and the technical support employee at UUM Postgraduate CAS department. In order to provide consistent and quality support to the students, staff and lecturers. In the proposed system we are going to use a problem tracking technique to track the information and problems that come from the customers into the Help Desk. In addition, assign or forward the problems to the appropriate workgroup and make sure that the problems are solved. Research Questions Based on the problem statement mentioned before, the following questions are constructed: What are the Limitations of the current UUM Postgraduate CAS help desk system? What are the techniques that we are going to use during the developing stage of the prototype of Postgraduate UUM help desk system? How can we evaluate the effectiveness of the proposed system? Research Objectives The main objective of this study is to enhance the current technical support of UUM Postgraduate department by developing an organized and significant web-based technical support system based on a problem tracking technique. In order To achieve this main objective, some sub-objectives can be formulated: To identify limitations of the current help desk system. To design and develop a prototype web-based help desk system based on problem tracking technique. To evaluate the prototype web-based help desk system based on problem tracking technique among the users. Significance of the study The proposed model will provide a significant and flexible way of communicating between the customer service at UUM and their users. Here are some significant and beneficial achievements that the proposed system is expected to provide: The system can assist the students in postgraduate department to find the solutions for routine questions through FAQ part and manage its requests by using problem tracking technique. The system will help the university to build a strong relationship with their students. Increase the productivity of the employees at work and provide faster and more convenient services to their students, staff or lecturers. All the users requests will directly send to the proper department of the customer service for finding a solution instead of sending all requests to one customer service department and then this department will try to find the suitable person who can answer the incoming request, and here we waste the time. Thus, we expect from this system to enhance the previous customer services tools and make it more effective and organized. Scope and limitation of the study This study will focus on developing a web-based help desk system using a problem tracking technique for Postgraduate UUM-CAS department at UUM. This system will let users (staff, students or lecturers) to freely interact with the technical support employees who have the ability to answer all problems related to the postgraduate services provided by the UUM-CAS. In addition, UUM-CAS postgraduate students can navigate FAQ section which contains a groups of frequently asked questions that are related to UUM-CAS Postgraduate department at UUM and they can find their problem or inquiry there. Moreover, the proposed system will help the students, lecturers, and staff at UUM-CAS postgraduate department to see the latest UUM-CAS postgraduate news and articles added by the technical support employees. The prototype to be developed is based on problem tracking technique. Organization Of The Report This report consists of six chapters which will cover the designing and the developing online help desk system for UUM-CAS postgraduate department at UUM. Here is an overview of the content of each presented chapter: Chapter One: this chapter introduces the problem, gives an overview about the study and describes the needs of help desk systems in the educational sectors. This chapter also discusses the scope of the study, the significance of the study and its objectives. Chapter Two: this chapter covers the literature review which is the previous related works that been done before. Moreover, this chapter represents relevant information for understanding the study more. Chapter Three: this chapter explains the details of the selected methodology that we are going to use in the project. These will vary depending on factors such as the generation of the support site, the tools employed, the profile of the customer base, the services offered, and so on. The Benefits of Single Source Access A Web-based support site that contains documents such as Knowledge base, FAQs, News, and so onà ¢Ã¢â€š ¬Ã‚ ¦This documents will provide users with a single source access to the service provided by the institute or the organization. Implementing Online Helpdesk System, management can have a single point of contact with the users and resolve their problems (Czengel, 2001). In addition to the two benefits that we have mentioned before there are some other important benefits of using Online Helpdesk Systems and they are as follows: Improved help desk service quality as all inquiries or problems are immediately taken action timely identification, diagnosis and resolution of problem Improved user or customer satisfaction. Providing existing users or customers with knowledge and FAQs (Frequently Asked Questions) concerning the educational institutions services. 24-hour availability which means that the system is available always to receive the problems or inquiries from the users at any time and in any day. Troubleshooting features gives users or customers the ability to solve many support problems on their own. This tool provides the users or customer with an easy way of connecting with the technical support employees and within a convenient time. Serves as a tool for tracking and recording helpdesk inquiries, which provides a knowledge base of resolutions to previous calls concerning similar issues. The Potential Pitfalls of Web-based Support The potential pitfalls in Web-based support come from poor planning and implementation. A site that offers little actual value to the customers or users, no matter how visually perfect it is, is worthless. Sites that are difficult to navigate, that contain out-of-date information, that do not offer help for the most common problems, that are designed at too advanced or too simple a level for the customer base they support all fall into the worthless category. You can spend a fortune on support tools, but if you havent done a thorough job in planning and implementation, your support site will fail and you will get no payback on what you invested. Customers/users will go to alternatives such as telephone support, and getting them back to the Internet would be difficult (Czengel, 2001). Web-Based Application Web application known as an online communication services that client can access through their computer or handheld devices, this communication can be optimized via network support such as the Internet or an intranet (Grove, 2009). Problem Tracking Technique There are many researches had been done before using a Problem Tracking Technique. This technique had been used in order to improve the efficiency of using help desk systems by the users. One of the research that had been already done is a help desk system that had proposed for The Information Technology Services Department in North Dakota State University . The system allows them to track problems by assigned person, assigned group, for a specific user and many other ways. They can generate ad hoc reports to analyze problems that have occurred over a set period of time or by department as needed. Thus, For a help desk to be effective and efficient, it needs to have a proper set of tools. These tools are used to manage the incoming calls, monitor servers and network connections, track problems as they enter the help desk and are transferred to other support units, being able to view the end users screen, documentation, training and many others. User Part Once the user did not find the solution of his /her problem in the FAQ part, he/she is going to use the ticketing system which is one of the system functionality. The user will create a new ticket and include his/her inquiry or problem within this ticket. The process of creating new ticket includes several steps. At the beginning the customers must choose the section that the faced problem belongs to. For example students fees section or registration section. After that, the customer will enter his/her personal information and he can specify a priority to his/her ticket for example urgent or normal .The customer can attach a file with his/her ticket in order to explain his/her problem more (Edwards, 2010 and Kayako, 2009). Technical support employees part After the user completes the process of sending his/her ticket to the suitable group of the technical support employees, here comes the role of technical support employees to respond to this ticket .Each ticket has a status which can be Open, Waiting for reply or Closed .Once the user creates his/her new ticket and sends it to the technical support employees, the status of his/her ticket will be automatically Open since it is a new ticket. Thats mean it needs a reply from the technical support employees. After one of the technical support employees replies this ticket, he/she will change the status of this ticket to be Waiting for reply which means the ticket has been replied by the suitable technical support employee and its status now is Waiting the user to send another reply if the first answer that he/she already got is not clear enough. Suppose that the customer needs more explanation or more details about his/her problem, then after he/she got the reply from the customer servic e, the user can change the status of this ticket from Waiting for reply to be Open and send it again with his/her new inquiry to the customer service employees. The status of the ticket will automatically become closed after a period of time called DUE which is specified by the administrator of the system and it is defined as the maximum time that the ticket will be remained in case of waiting for a response from the user. That means after the expiration of this time, the status of the ticket will be closed. After this time called DUE the ticket will be closed and it will become as a read-only ticket from the side of users. In other words, the problem has been solved and does not need any reply anymore. The last thing that we want to indicate that imagine that a user has sent a ticket to the technical support employees through the system and lets answer this question: what will happen if the ticket still in the queue of the tickets queue without any answers from any technical suppor t employee? In fact this case is the worst case that it might make the user in the status of waiting for reply through unlimited time. In order to handle this problem, In the proposed system there is a part for administrators which enable the help desk managers or administrators to monitor and manage the process of ticketing system. They can view the tickets that no one has answer it and assign it to the suitable technical support employee. (Edwards, 2010; Schauer Thompson, 2004; and Kayako, 2009). Building up FAQ Building up FAQ is also an important task of help desk. The purpose of building up the FAQ is to reduce the number of inquiries that come from users. Users can browse the FAQ pages and clear up their unfamiliar matters before they send emails or tickets to the help desk employees. Help desk employees also can analyze inquiry records, construct questions and add them to the FAQ part. For example, if the help desk employees see that there are questions that come out from users several times, then they can simply organize these questions by added them to the proper group of FAQ section so the users can find it there before they send a new question which is already exists at FAQ section (Iwai, Iida, Akiyoshi Komoda, 2010 and Kayako, 2009). UUM-CAS help desk mechanisms In the meanwhile, the current technical support mechanisms used by UUM-CAS postgraduate technical support department are still limited to phone call and email as a way of communicating between users and the technical support employees. Generally, the disadvantages of using this current techniques are divided into two parts based on email or phone call. The first part of disadvantages are the problems of using phone call as a tool of providing the technical support service. The first problem of using the phone call is that the technical support employees are not always the same who answer the phone. Which means, every time you talk to different technical support employee, you should explain your problem again and again until you get the solution of your problem. The second issue of using a phone call is the wasted time that the user should wait since he/she may pass on from one technical support employee to another until he/she gets the answer of his/her problem or inquiry. The third issue appears during the registration time while the pressure on the technical support center is more comparison to other time and especially on using phone call. At that time, the user should wait on the phone until he/she can talk to the customer service employees since the phone is busy. From the other side, there are some issues comes from using the email as a way of interacting between the users and the customer service employees. First of all, it takes long time from the customer service employees side until they solve the issues since the problem will not be received from the proper technical support employee who has an infrastructure about the problem that had been sent by the users. The second thing is multiple people could work on the same email or no one would handle it since some customer service employees will assume that other employees would handle it. Thus, and as we can see there is no standard and organized way of handling with the users inquiries and problems. Chapter Summary The analysis of literature review had broadened the scope of Online Helpdesk issues. The information and findings collected form this chapter is used as a guidance to develop the Online Helpdesk system. By reviewing the UUM-CAS postgraduate help desk case study, we can conclude that helpdesk system plays an important role in the educational institutions. This chapter has also demonstrated the importance of helpdesk system in the context of UUM-CAS postgraduate help desk department. CHAPTER 3 RESEARCH METHODOLOGY Introduction This chapter discusses the adopted methodology which applied to achieve the objectives of the study in designing and developing the proposed web-based help desk system for UUM-CAS help desk department. Research Methodology Research methodology plays a very important role to proceed and carry out with the whole all research study. Moreover, it is very important to choose the suitable methodology for your study in order to achieve the objectives of the study. In general, a lot of studies that had been done before use the research methodology to achieve many purposes such as gathering data and information, development and evaluation (Refsdal, 2008 Schmuller, 2002). Besides that, Research methodology step makes us fully awareness about the requirements of our study and the problem statement of the research. Thus, The methodology of this research the we are going to apply is based on the five general research steps that are proposed by Vaishnavi Kuechler. These steps includes the awareness of problems, suggestions, development, evaluation, and the conclusion of the research as they are illustrated in the Figure 3.1. The awareness of problems In this step, some important information had been gathered about the current problems and limitations of using the current traditional help desk mechanisms at UUM-CAS help desk department. This can be achieved by interviewing the students, lectures, and staff to see what are the disadvantages of using the current customer service in order to overcome it. Moreover, we can use some beneficial instruments such as questionnaire. In addition, we can collect some information from some related work that had been done before by other researchers. Thus, This step aims to identify the problems and come out with a significant and more organized solution. Suggestions The second step of the methodology of this research is to suggest building a web-based application based on problem tracking technique in order to enhance the current technical support tools used by UUM-CAS help desk department. In this phase, some flow charts and some Unified Modeling Language (UML) diagrams will be used to design the proposed prototype. The Figure 3.2 illustrates briefly the technical support operation of the proposed system: Figure 3.2: Diagram explains the proposed system Design Pattern Design patterns describe how objects communicate without become entangled in each others data models and methods. Keeping this separation has always been an objective of good OO programming, and if you have been trying to keep objects minding their own business, you are probably using some of the common design patterns already (Cooper, 2002). Why Design Pattern? Why do we need to use design pattern? Nowadays computers programs is becoming more complicated, for this reason it is important to have a way of making building software easier and less complexity. For example, SQL Server and Oracle are become the most common databases used in the meanwhile . Lets imagine that we are working in a software company and we already developed a costly system using SQL Server database and because of a certain reason the company wants to change its database server into Oracle. Does that mean we want to ignore everything has been built and start building our new system from scratch? The answer is no of course. By using a design pattern we will be able to build a system which rebuilding ability exists. As a result, we just need to change the part of code which deals with SQL Server with Oracle one. Design pattern has divided the system into layer each layer has its own job starting from the View layer and ending with the database layer and the figure 3.4 belo w is really express what i just mentioned. If we ignore using design pattern in our system , then our system simply will miss the usability technique. As the figure 3.5 shows that we should not ignore the Business tier and dealing directly with the data tier if we do so then it is hard to make changes in the application. Thus, In this case and if we want to change in one place, then we should change in many other places that are related to the change instead of make the changes in one place by using the organized design patterns. To explain how does the design pattern technique work, lets take the following scenario : Once the system has started, it will collect some configurations from configuration file about the connection string of the database and the name of Business Logic Layer DLL (BLL). That means the connection with the database will not establish until the business layer successfully retrieved the configuration from the configuration file. Business Logic Layer is responsible for retrieves data from the data layer, so the business logic layer plays the role of mediator between presentation layer and database layer. IDAL (Interface Data Access Layer) is an interface that we just need to deal with it regardless the type of database that the system works with. Hardware Requirements Of The System Since the proposed system is a web-based application, so to run the system on the web environment we need a web application server that can handle the requests that come from the users of the proposed help desk system. In addition to the web server, To run the system on the web server, it has to have the minimum hardware characteristics that enable the web server from installing dot net features such as dot net framework which is necessary to run the application on the web server smoothly and successfully. Software Requirements Of The System As we mentioned in the hardware requirements of the system, we need to install the dot net framework on the web server since the developing environment of the proposed system is Microsoft Visual Studio and this framework is necessary to run the application successfully on the server. Besides that, a web browser application is necessary to be installed which is the middle tool that will make the connection with the system application which is running on the server side. User Requirements Of The System Generally, The user of the proposed system is divided into three categories. That is, UUM users (student and lecturer), technical support employee, and administrator. Each group of the system has its role based on its authority of using the system. Since the proposed system consists of three parts ( User, Technical support employee, Administrator) , each group of the users can use the suitable part based on their authority. UUM users can use the user part of the system to submit the problems as a tickets to the customer service employees. In addition, they can see the latest news and articles added by the customer service employees and download the files that are related to UUM-CAS. While the technical support employees are responsible to respond to the tickets that come from the user part, in addition to manage the articles, news and download sections in the user part. The Government”s Taking of Private Property

The Constitution of the United States is based primarily on the ideas of the 17th Century English philosopher John Locke. Locke thought that everyone had natural rights, which included life, liberty, and property. Locke stated â€Å"the great and chief end, therefore, of men†s uniting into commonwealths, and putting themselves under government, is the preservation of property† (Locke/ McClaughry 3). He thought that if any of these rights were violated that the violator should make restitution. The Takings Clause in the Fifth Amendment of the Constitution states â€Å"Nor shall private property be taken for public use, without just compensation. When the government needs a citizen†s private property to build roads or buildings, they compensate the person with money roughly equal to the value of that person†s land. The problem of the government taking or restricting a citizen†s land arises with regulation of private property. John McClaughry defines regulatory taking â€Å"as a governmental confiscation or destruction of economic rights by regulation, without the physical occupation which would trigger just compensation to the owner† (McClaughry 7). The case of Lucas v. South Carolina Coastal Council is an example of regulatory taking. In the case of Lucas v. South Carolina Coastal Council, Lucas bought two adjacent lots on the coast of the Isle of Palms in South Carolina, only to have the land restricted by the state, which prevented his intended use of the lots. Lucas argued that the state†s restriction of the land constituted taking without just compensation. The South Carolina Court of Common Pleas agreed with Lucas and awarded him $1,232,387. 50. The Supreme Court of South Carolina disagreed with the lower court, and saying that the restrictions were designed to prevent serious public harm so no compensation was necessary, even if it did affect the property†s value. Lucas appealed to the Supreme Court of the United States. The Supreme Court of the United States decided on Lucas v. South Carolina Coastal Council in June of 1992. This was four years after the Beachfront Management Act, which prohibited construction on Lucas† lots, was enacted in 1988. An amendment was made to the Act in 1990 that would allow construction in special situations. Lucas could possibly appeal to the Council and receive a permit to build on his lots at the time of the Supreme Court hearings. Lucas argued that the deprivation of use of his land from 1988-1990 amounted to a taking. The Supreme Court decided to grant certiorari. According to Locke, the government†s purpose is to protect and enforce people†s natural rights. One of the natural rights, according to Locke, is life. The coastal area of the Isle of Palms that Lucas† lots were on has been plagued with floods. Justice Blackmun stated that the land was â€Å"under water† from 1957 until 1963. In addition, between 1981 and 1983, â€Å"the Isle of Palms issued twelve emergency orders for sandbagging to protect property† (Blackmun 2). The state of South Carolina saw Lucas† property as unsafe. â€Å"Long ago it was recognized that all property in this country is held under the implied obligation that the owner†s use of it shall not be injurious to the community, and the Takings Clause did not transform that principle to one that requires compensations whenever the State asserts its power to enforce it† (Keystone Bituminous Coal Ass. 491-492). The state†s prevention of building on the site in question would not only foreseeably save the beach from erosion,! insurance and federal aid money, but possibly lives. The Supreme Court ruled in this case that when all value has been taken from property that the owner must receive compensation for it. The question still stands as to whether the state caused the land to become valueless by restricting the building upon it. Justice Blackmun argued, â€Å"†¦ yet the trial court, apparently believing that ‘less value† and ‘valueless† could be used interchangeably, found the property ‘valueless†Ã¢â‚¬  (Blackmun 5). He goes on to propose that the land still held value because Lucas could enjoy it in other ways, such as camping, swimming, picnicking, or placing a mobile home on it. The value of the property often lies in the eye of the beholder. In Colorado, a piece of legislation is being proposed that might become a model for other states where property rights are concerned. The Private Property Protection Act would allow â€Å"a landowner to seek compensation when a regulation takes away more than fifty percent of the land†s value† (McClaughry 4). This act hopes † to establish a standard for the most serious regulatory takings and to afford a method of relief for a landowner whose rights have been taken† according to McClaughry (McClaughry 8). In 1997, Senator Hatch (R-UT) introduced a piece of legislation called the Citizen†s Access to Justice Act. This Act would â€Å"reduce delay and expense of litigation by clearly defining when a property owner†s claim is ripe† for adjudication (Annett 2). This piece of legislation would help speed the process that is so costly for property owners. The Private Property Rights Implementation Act was passed in October of 1997. This Act helps owners pass their first hurdle by allowing them to have the merits of their case heard in federal court. The Tucker Act Shuffle Relief Act, also passed in October of 1997, helps citizens pass the second hurdle by â€Å"resolving the jurisdictional question for federal courts† (Annett 3). Even though the Supreme Court†s ruling in Lucas looked promising for property rights advocates, it turned out not to be such a big win after all. Justice Scalia limited the application of the ruling to total takings, excluding partial takings. The distinction between total and partial takings â€Å"is arbitrary and inconsistent with the purposes of the Takings Clause† (Butler 3). It is possible that one landowner could lose more money on a piece of property that is only partially taken and not receive compensation for it, when another landowner could be compensated for a piece of land that is not wholly worth as much as the other owner†s partial piece. The Supreme Court†s partial versus total taking has made a big impact upon lower court judges however. The lower courts are using the decision as a standard by which to judge regulatory property rights cases across the board. Many defendants are attempting to use the ruling, to fight prohibited construction on their land, where it is not applicable. Defendants â€Å"cannot claim their land is valueless simply because they might have developed it in the future† (Butler 5). The other relevant part of the Lucas decision is that â€Å"if the activity was previously permitted under relevant property and nuisance principles, then the prohibition of the activity would be a total regulatory taking that must be compensated† (Butler 6). Justice Blackmun ponders whether the government is going to be able to continue if it must weigh the possibility of compensation when making laws outlawing serious dangers to society. However, if all economically beneficial uses are not destroyed by the regulation, then it does not matter whether or not the activity was previously permitted. Another case of regulatory property taking that is still on the state level is the expansion of the Minneapolis-St. Paul Regional Airport. With the expansion of the airport, increased air traffic would be flying over the nearby Minnesota Valley National Wildlife Refuge. In compensation for the affects on the habitat, â€Å"†¦ the Fish and Wildlife Service is going to be paid over $20 million† (Young 1). However, the money is going to come from fees and charges placed on people using the airport. When someone from the private sector causes detriment to federal lands they must compensate the government for the lost lands. The end of Lucas v. South Carolina Coastal Council remains to be told. The South Carolina Supreme Court ordered the state of South Carolina to purchase the two lots in question from David Lucas. The state then put the two lots on the market as residential sites. Perhaps the â€Å"courts should look beyond the public-interest rhetoric and examine the validity of the alleged public purpose† (Butler 7). This is the other side of regulatory takings. If the states are required to pay property owners millions of dollars for the land in question, are they going to be able to uphold the Acts and legislation that got them there? Locke†s natural rights seem to conflict over the regulatory taking of private property. The natural right to life appears to have precedent over the natural right to property according to the government†s actions in dealing with regulatory takings. The government says that the taking of the land is in the best interest of society, but rights of the individu! al are being overlooked. When the taking is free to the government, it appears to be a good plan of action for them. When the government must pay for their land, they weigh the pros and cons of their decisions a little more heavily. The Lucas case is full of precedents, good and bad, for both sides of the issue of regulatory takings.

The Worker Next Door

In the essay â€Å"The Worker Next Door† written by Dr. Chris Chiswick, the author addresses the illegal immigrant problem in America, and gives several questionable reasons how if the flow of illegal immigrants were deterred, jobs would still be filled, and life would go on as usual, or even better. Dr. Chiswick wrote a not too convincing essay, having many places where he could have improved or even left out certain parts of his essay that would have made this writing better, and more realistic to his audience. I spotted a couple areas where the author went on a tangent of barely related areas to illegal immigration. Along with that, it doesn’t really seem like he tried to appeal to ethos too much, but gives some attention to logos and pathos early on in the essay and at the end. The first paragraph of this essay is a rhetorical question that asks how different life would be if illegal immigrants were not in the country doing low-class, low-skilled, and low-wage jobs that most Americans would not do. This question is a good way to start the essay, making the reader think a little, and get more interested in the topic while also revealing the authors purpose; to persuade the reader into thinking that illegal immigration is not necessary for the American economy. This purpose is hinted throughout the course of the essay, but is most obvious in his thesis in paragraph eight. As the essay progresses, it becomes clearer that Chiswick’s audience is the American public who live in states with high illegal immigration, specifically from Mexico, as his title so subtly states. Not so subtle in his essay however, is his claim in the third to last paragraph, where he states that â€Å"Less frequent lawn mowing and washing of hotel sheets and towels would reduce air, noise, and water pollution in the bargain. †. Chiswick can have all the Ph. D. s in the world, but its not going to make illegal immigration from Mexico a realistic strain on pollution in America. While the author may not do too well on appealing to ethos, he does make an attempt to make up for it on logos, when he gives data from the U. S. ensus, saying that 64% of lowskill jobs were done by native born Americans while only 36% were foreign born. The problem that I had with this is that no where in this statistic does it mention illegal aliens, which this essay is supposedly about. If illegal immigration is such a big concern for this man, then why does he have to resort to a barely related statistic to get support from? This leaves us to the last appeal available, pathos. Chiswick used pathos most evidently and strongly in the last paragraph, with a hint of ethos, to give a final attempt in convincing his readers. His entire essay up to this point is about how America would be far better off economically without illegal immigration from Mexico, but then he quickly turns from criticizing and blaming aliens to praising the genius of the American public and economy. If his strong attempt at the use of ethics by showing he knows a little American history does not impress a simple high school student, I can’t imagine what his informed, educated, and mature audience would think. Have you noticed how in this very essay, there doesn’t seem to be a nice flow between topics, and that things may at times, seem fairly irrelevant to the subject at hand? This is how i felt while reading â€Å"The Worker Next Door†. Chiswicks organization is flawed, jumping from claim to claim without any real connection between the two. It might be just me, but I don’t really see the link between suggesting bad hygiene (â€Å" Hotels and motels could reduce the frequency of changing sheets and towels†¦ to every third day†) and how home owners could switch grass species. If Chiswick knew his audience properly, he would know that Americans are generally lazy, and we are getting lazier(CNN). At first, I thought Chiswick was a reasonable guy. He pointed out how places with little to no illegal immigration still had groceries bagged, lawns cut, and hotel sheets changed. But what he failed to point out was that these places are usually small towns out in the middle of nowhere, where the standard of living is lower, and the local economy is stagnant. Not fully thinking his statement through hurt the credibility of his essay, and the ridiculous claim that illegal immigration contributes to our pollution is absurd. Chiswick’s essay could have been much better than this. Someone who has a Ph. D. in economics and is writing a persuasive essay should have many more sources, facts, and realistic examples. The strongest case Chiswick could come up with is that immigration is driving down the living standards for low-skilled workers, as if he were writing his essay to help them out. But these workers aren’t immigrating to a lower standard of living. They’re immigrating to a country that has a much higher standard of living, even for low-income workers.
